Problem

The creditor here is not a business at all. A private lender who advanced money to someone they knew personally, with no invoice, no contract and no company behind them to absorb the loss if it went unpaid.

Personal debts are the easiest of all to lose. Money passes between people who know each other with no invoice, no due date and nothing signed, and the lender is reluctant to sour the friendship by asking a second time.

Here the lender had sent SGD 4,000 in two transfers, and the borrower had acknowledged the debt in a chat message and promised to repay once a bonus came through. The bonus came and went. The replies grew shorter, then stopped.

The lender's own assumption was the real obstacle. They believed that because nothing had been signed, there was nothing to act on, and they had no interest in taking a friend to court over it.

What this case shows

A signed contract is not what makes a personal debt recoverable. A dated acknowledgement and a record of the money moving will usually do, and most private lenders already have both without realising it.
